Kennedy Terms
ONLINE RETURNS POLICY
This website and online store is owned by Kennedy Luxury Group Pty Ltd (we, us and our). By purchasing any product through the Kennedy online store, you agree to be bound by and abide by the terms and conditions of this online returns policy (Returns Policy). This Returns Policy forms part of, and should be read together with, our Terms of Use. This Returns Policy is separate from our retail store returns policy.
1. Change of mind
1.1 If for any reason you change your mind about your purchase from this website, you have 14 days from the date you receive your order to contact Kennedy to return the product in accordance with the returns process in clause 3. Subject to and without limiting your rights under the Australian Consumer Law, Kennedy will provide you with a full refund of the product provided the following conditions are met:
- you provide us with proof of purchase of the product;
- the product is in its original packaging and original condition;
- the product is not customised, personalised or altered;
- the product is not earrings; we cannot accept earrings for returns for hygiene reasons, unless faulty or where we have failed to comply with a consumer guarantee under the Australian Consumer Law;
- the product is not a fragrance; due to the nature of these products, we cannot accept returns of fragrances, unless faulty or where we have failed to comply with a consumer guarantee under the Australian Consumer Law;
- the product is unused; and
- the product has all tags attached that are untampered and unbroken.
1.2 If the product is returned and it does not meet the above conditions, we will send the product back to you.
1.3 The conditions in clause 1.1 (other than the first condition) do not apply to products returned under clause 2.
2. Faulty goods
2.1 If the product you purchased through this website is faulty or does not correspond with your order, or we have failed to comply with a consumer guarantee under the Australian Consumer Law in relation to the product, we will provide the applicable remedy below on the condition that you provide us with proof of purchase of the product and subject to the exclusions in clause 2.4.
2.2. If the issue with the product is major, we will, at your discretion, offer you:
- a full refund or a replacement product if you return the product to us in accordance with returns process in clause 3; or
- compensation for any loss in value if you choose to keep the product.
2.3. If the issue with the product is minor, we will, at our discretion, offer:
- to repair the product within a reasonable time, or
- to replace the product; or
- to provide you with a full refund.
2.4. Subject to and without limiting your rights under the Australian Consumer Law, we will not provide a remedy to you if you have caused the product to become faulty, the product has been damaged or altered after it was delivered to you (for reasons unrelated to the condition of the product at the time of delivery), the product has been used in an abnormal way, contrary to the product’s instructions manual or not maintained in accordance with the recommendations in the instructions manual.
3. Returns Process
3.1. If you wish to return a product for any reason, please contact our dedicated Customer Care Team at customercare@kennedy.com.au or via phone at +61 1300 536 633 to organise the return. Your request for a refund or exchange will be processed within 21 business days of receipt of your request. Kennedy will arrange for pick up of the product from your home, work or an alternative address at no cost to you and you must comply with the returns instructions provided to you by Kennedy. We also offer complimentary shipping for any item that you would like to return and you may also return your item at any of our retail stores in Australia.
4. Australian Consumer Law
4.1. Nothing contained in this Returns Policy excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law.
RETAIL STORE RETURNS POLICY
This retail store returns policy (Returns Policy) applies to any purchase made in any physical Kennedy retail store. This Returns Policy is separate from our online returns policy. Our retail stores are owned by Kennedy Luxury Group Pty Ltd (we, us and our). By purchasing any product through the Kennedy retail stores, you agree to be bound by and abide by the terms and conditions of this Returns Policy.
1. Faulty Goods
- If the product you purchased through our store is faulty, or we have failed to comply with a consumer guarantee under the Australian Consumer Law in relation to the product, we will provide the applicable remedy below on the condition that you provide us with proof of purchase of the product and subject to the exclusions in clause 1.4. We do not accept 'change of mind' returns of products purchased in-store.
- If the issue with the product is major, we will, at your discretion, offer you:
- a full refund or a replacement product if, subject to clause 1.5, you return the product to us in-store; or
- compensation for any loss in value if you choose to keep the product.
- If the issue with the product is minor, we will, at our discretion, offer:
- to repair the product within a reasonable time, or
- to replace the product; or
- to provide you with a full refund.
- Subject to and without limiting your rights under the Australian Consumer Law, we will not provide a remedy to you if you have caused the product to become faulty, the product has been damaged or altered after you collected the product in-store or it was delivered to you (for reasons unrelated to the condition of the product at the time of collection or delivery), the product has been used in an abnormal way, contrary to the product’s instructions manual or not maintained in accordance with the recommendations in the instructions manual.
